To qualify for a 179D tax deduction under the Energy Policy Act, your building must meet the following threshold criteria, in addition the energy efficiency requirements of the Energy Policy Act:

  • Building was placed in service on or after January 1, 2006
  • Building is a commercial building
  • You are the owner OR you are the designer of a building owned by federal, state or other government
  • Building is located within the U.S. or its territories
  • Building is new construction or substantial renovation to HVAC, lighting and/or building envelope
  • It is recommended that the square footage of building or renovation be at least 25,000 square feet
